An Enforcement Notice is one of the most commonly-used methods of requiring compliance where there has been a change that requires planning permission.
If an Enforcement Notice is issued, it is absolutely essential that this is dealt with promptly. There is a route of appeal but if it is not lodged within a stipulated period of time, normally 28 days from receiving the Notice, the requirements of the Notice take effect and become enforceable against you.
The appeal can be on a number of specified grounds, such as that planning permission would have been granted if it had been applied for. We regularly deal with this type of work and have a good track record at finding a solution to this form of enforcement action.
We have prepared an Enforcement Notice Guide that sets out the route of appeal in more detail.
